As reported by Joseph Blakely of Cardiff Daily, Yasmin Sarwar, aged 48, is facing nine counts of theft and fraud. Prosecutor Mark Cotter KC told jurors that the couple treated the high-performing educational institution as their “personal piggy bank” and allegedly utilised charitable funds to support a “lavish lifestyle”.

Mr Cotter outlined to the court that Cardiff Sixth Form College developed into one of the country’s top-performing sixth-form institutions, drawing international students and earning widespread academic acclaim. According to the prosecution, Mrs Sarwar initially began as an A-Level tutor before helping establish the college as a registered charity.

Mr Cotter alleged that both she and her former husband repeatedly diverted money generated by the college for their own benefit. As stated by Mr Blakely of Cardiff Daily, the prosecutor told the court:

“Their assault on the charitable funds was so relentless and widespread that it proved impossible for accountants retained by the college to produce proper audited accounts.”

The prosecution detailed that the couple appointed accountant Ragu Sivapalan, aged 41, who allegedly accepted information provided to him “at face value” and produced misleading financial reports.

As reported by Joseph Blakely of Cardiff Daily, the prosecution alleges that Mrs Sarwar established two separate companies named Ayass Ltd and Ayass Guardianship Ltd. These entities were supposedly presented as providers of welfare programmes and student services. However, the court heard that these services were actually delivered by the college itself, while substantial payments were systematically channelled to the private companies.

Mr Cotter alleged that these firms served as a mechanism to transfer large sums away from the charity and directly into Mrs Sarwar’s control following the deterioration of her relationship with Nadeem Sarwar during divorce proceedings.

When and How Did Financial Irregularities Come to Light?

According to the evidence presented in court, concerns regarding the institution’s finances began to emerge after Gareth Collier joined as head of pastoral services in 2015.

As reported by Joseph Blakely of Cardiff Daily, Mr Collier became suspicious after being instructed to reimburse overseas travel expenses from a brown paper bag allegedly containing cash. He reportedly also noticed bank statements revealing payments of £25,000 labelled “Naz Agents Commission”. When Mr Collier raised these issues, Mrs Sarwar reportedly blamed her former husband for taking money from the college.

Finance assistant Hindia Ahmed allegedly questioned the whereabouts of £1.8 million that appeared to be missing from the accounts prior to a planned inspection. The co-accused accountant, Mr Sivapalan of Penylan, Cardiff, has already pleaded guilty to causing an auditor’s report to include misleading, false, or deceptive information between January 2013 and July 2016.
